Right of withdrawal

In accordance with the provisions of the Consumer Code (Legislative Decree No. 206 of September 6, 2005 modified by the Legislative Decree No. 21 of February 21, 2014) if the customer is the consumer (an individual who buys products for purposes and not for manufacture or resale, that means he does not state a Vat Number in the order form to Seven Spa) he has the right of withdraw from the sale contract without any justification, nor pay any penalty within 14 days from receiving the product.

The right of withdrawal cannot be exercised for personalized products according to specific customer’s requests (i.e. products with name, numbers, first letters and so on).

In order to exercise this right of withdrawal the customer shall notify Invicta Spa in written form within 14 working days from receiving the goods ( you can fill up the Model Withdrawal Form attached to the general condition of sale).

within 14 working days from receiving the goods.

When the notice of withdrawal is received Invicta Spa’s Customer Service will prompty send the customer instructions on how to return the goods.

Customer must return the item to the seller or to a third party indicated by the seller without delay and in any case within the mentioned term of 14 days that begins after receiving the instructions in written. Customer has to bear the ordinary costs of return.

The product must not be damaged, used and must be given back in its own original package with all contents (including packing materials, documents if any, etc.);

Customer can handle the product to understand its features and how it works but he is responsible for any damage provoked by improper use.

If the customer exercises the right of withdrawal all the payments done to the seller will be refund just as the initial shipping cost (except for a particular kind of shipment choosen by customer that is more expensive than standard shipment methods) just when the item will be delivered or when the customer can prove he shipped it. Refunds payments will be made using the same payment method used by the customer unless he requires another one.

According to art.59 of the Consumer Code there are some exceptions in the right of withdrawl: if the item will be damaged during the shipment Seven Spa will inform the customer

(within 5 working days from the receiving item into their own warehouse) to enable the Consumer to submit a complaint promptly to the courier he

has chosen and reclaim refounds if it is insured.

In this case the item will be at the customer’s disposal cancelling at the same time his request for withdrawal; Seven Spa declines all liability for damage, theft or loss of goods returned by uninsured shipping. When the article arrives in the warehouse it will be examined to check for possible damage or tampering not referable to the transport.
